Terms of Service

Agreement to Terms

By accessing or using the services provided by Kushsan Inc. ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access our services.

Services

Kushsan Inc. provides IT services including but not limited to web development, mobile app development, UI/UX design, cloud services, AI solutions, and ongoing maintenance. The specific scope, deliverables, and terms of any project will be outlined in a separate agreement or statement of work.

Intellectual Property

Client Ownership

Upon full payment, clients retain ownership of all custom code, designs, and deliverables created specifically for their project, unless otherwise specified in the project agreement.

Company Materials

We retain ownership of our proprietary tools, frameworks, libraries, and methodologies that may be used in delivering services. We grant clients a non-exclusive license to use these materials as part of their delivered project.

Payment Terms

• Payment terms will be specified in individual project agreements
• Typical arrangements include milestone-based or monthly billing
• Invoices are due within 30 days unless otherwise agreed
• Late payments may incur interest charges

Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of any agreement.

Warranty and Support

We provide a 30-day warranty period after project delivery during which we will fix any bugs or issues at no additional cost. Extended support and maintenance packages are available separately.

Limitation of Liability

To the maximum extent permitted by law, Kushsan Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Termination

Either party may terminate an agreement with 30 days written notice. In case of termination, the client will pay for all work completed up to the termination date.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting on our website. Your continued use of our services after changes constitutes acceptance of the updated Terms.
